HAERA Terms of Service

Effective Date: June 19, 2025

Article 1 (Purpose)

These Terms of Service ("Terms") are intended to define the terms and conditions for the use of mobile application services provided by HAERA ("Company"), procedures, rights, obligations, responsibilities, and other necessary matters between the Company and users.

Article 2 (Definitions)

The definitions of terms used in these Terms are as follows:

  1. "Service" means the HAERA application and related services provided by the Company.
  2. "User" means members and non-members who receive services provided by the Company in accordance with these Terms.
  3. "Member" means a person who has registered as a member by providing personal information to the Company, continuously receives information from the Company, and can continuously use the services provided by the Company.
  4. "Non-member" means a person who uses the services provided by the Company without registering as a member.
  5. "Content" means all information, text, graphics, images, videos, advertisements, etc. provided within the Service.

Article 3 (Effect and Amendment of Terms)

  1. These Terms shall take effect for all users who wish to use the Service.
  2. The Company may amend these Terms when deemed necessary, and the amended Terms shall be notified through notices within the application or other methods.
  3. The amended Terms shall take effect simultaneously with the notice, and if users do not agree to the amended Terms, they may discontinue using the Service and withdraw.
  4. If users continue to use the Service after the effective date of the amended Terms, they shall be deemed to have agreed to the amended Terms.

Article 4 (Provision of Service)

  1. The Company provides the following services:
    • Ad-supported mobile application services
    • Personalized content and advertising services
    • Push notification services
    • Other services determined by the Company
  2. Services are provided 24 hours a day, 365 days a year in principle. However, services may be temporarily suspended due to business or technical reasons of the Company.
  3. The Company may change all or part of the services being provided according to operational and technical needs when there are reasonable grounds for improving and stable operation of the Service.

Article 5 (Service Use Application and Approval)

  1. Users apply for membership registration by filling in member information according to the registration form set by the Company and expressing their intention to agree to these Terms and Privacy Policy.
  2. The Company registers users who apply for membership as members unless they fall under any of the following categories:
    • When the applicant has previously lost membership qualification under these Terms
    • When there are false statements, omissions, or errors in the registration content
    • When it is determined that registering as a member would cause significant technical difficulties for the Company

Article 6 (Changes to Member Information)

  1. Members may view and modify their personal information at any time through the personal information management screen.
  2. When the information provided during membership registration changes, members must make online modifications or notify the Company of such changes through email or other methods.
  3. Members are responsible for any disadvantages arising from failure to notify the Company of changes mentioned in paragraph 2.

Article 7 (Personal Information Protection)

The Company strives to protect members' personal information in accordance with relevant laws and regulations. The Company's Privacy Policy and relevant laws apply to the protection and use of personal information.

Article 8 (Company's Obligations)

  1. The Company shall not engage in acts prohibited by laws and these Terms or contrary to public order and morals, and shall strive to provide services continuously and stably in accordance with these Terms.
  2. The Company shall establish a security system for protecting users' personal information so that users can safely use internet services.
  3. When opinions or complaints raised by users are objectively recognized as legitimate, the Company shall immediately process them through appropriate procedures.

Article 9 (User's Obligations)

  1. Users shall not engage in the following acts:
    • Registration of false information during application or modification
    • Misappropriation of others' information
    • Alteration of information posted by the Company
    • Transmission or posting of information other than that designated by the Company (such as computer programs)
    • Infringement of intellectual property rights such as copyrights of the Company or third parties
    • Acts that damage the reputation of the Company or third parties or interfere with their business
    • Acts of disclosing or posting obscene or violent messages, images, sounds, or other information contrary to public order and morals on the Service
    • Other illegal or improper acts
  2. Users must comply with relevant laws and regulations, provisions of these Terms, usage guidelines, precautions announced on the Service, matters notified by the Company, etc., and shall not engage in acts that interfere with the Company's business.

Article 10 (Service Use Restrictions)

  1. The Company may restrict service use or terminate the service contract without prior notice when users violate the provisions of Article 9.
  2. The Company shall not be liable for service use restrictions or service contract terminations under paragraph 1 unless there is intentional misconduct or gross negligence by the Company.

Article 11 (Service Interruption)

  1. The Company may temporarily suspend the provision of services when reasons such as maintenance, replacement, and failure of information and communication facilities such as computers, or interruption of communication occur.
  2. The Company shall not compensate for damages suffered by users or third parties due to temporary suspension of service provision for reasons stated in paragraph 1. However, this shall not apply in cases of intentional misconduct or gross negligence by the Company.

Article 12 (Advertisement Placement and Transactions with Advertisers)

  1. Part of the service investment foundation that enables the Company to provide services to users comes from revenue through advertisement placement.
  2. Users agree to advertisement placement exposed during service use.
  3. The Company shall not be liable for losses and damages incurred by users' participation in, correspondence with, or transactions related to promotional activities of advertisers posted on the Service or through the Service.

Article 13 (Disclaimer)

  1. The Company shall be exempted from liability for service provision when services cannot be provided due to natural disasters or equivalent force majeure.
  2. The Company shall not be liable for service use disruptions caused by users' fault.
  3. The Company shall not be liable for users' loss of expected profits through service use, and shall not be liable for damages caused by data obtained through the Service.
  4. The Company shall not be liable for the reliability, accuracy, etc. of information, data, and facts posted by users on the Service.

Article 14 (Damage Compensation)

  1. The Company or users shall be liable to compensate for damages caused to the other party by violating these Terms. However, this shall not apply when there is no intentional misconduct or gross negligence.
  2. When the Company provides individual services to users by entering into partnership agreements with individual service providers, if damages occur to users due to intentional misconduct or gross negligence of individual service providers after users agree to the relevant individual service terms, the individual service providers shall be liable for such damages.

Article 15 (Dispute Resolution)

  1. The Company and users shall make all necessary efforts to amicably resolve disputes arising in relation to the Service.
  2. Notwithstanding paragraph 1, if litigation is filed due to disputes, the lawsuit shall be filed in the court having jurisdiction over the location of the Company's headquarters.

Article 16 (Governing Law)

Korean law shall apply to the interpretation of these Terms and disputes between the Company and users. However, when there are mandatory laws in the user's country of residence, such laws shall be applied preferentially.

Article 17 (Member Withdrawal and Loss of Qualification)

  1. Members may request withdrawal from the Company at any time, and the Company shall immediately process member withdrawal.
  2. When members fall under any of the following reasons, the Company may restrict and suspend membership qualification:
    • When false information is registered during membership application
    • When interfering with others' service use or misappropriating their information, thereby threatening e-commerce order
    • When using the Service to engage in acts prohibited by laws or these Terms or contrary to public order and morals

Supplementary Provisions

These Terms shall be effective from June 19, 2025.
